The management of the mineral and coal (minerba) mining sector has entered a new era, particularly after the enactment of Law (UU) No. 3 of 2020 on June 10, 2020. Within this law, companies are obligated to carry out post-mining reclamation. This became one of the key points refined in the regulation, specifically regarding reclamation and post-mining activities.
As a guarantee to ensure companies conduct mining reclamation, they are required to provide a financial deposit to the government. The guarantee that must be paid amounts to IDR 4.36 trillion for Post-Mining Guarantees and IDR 1.34 trillion for Reclamation Guarantees.
In Law No. 3 of 2020, holders of Mining Business Permits (IUP) and Special Mining Business Permits (IUPK) whose licenses are revoked or have expired but fail to carry out reclamation/post-mining activities or fail to place reclamation or post-mining guarantee funds may face a maximum criminal penalty of 5 years imprisonment and a fine of up to IDR 100 billion.
With these guarantees in place, stakeholders are obliged to restore the condition of the environment, the habitat of flora and fauna, and the productivity of post-mining areas to their original state, or even make them more beneficial for surrounding communities.
The existence of the Mineral and Coal Law provides significant benefits for the sustainability of mining ecosystems and has given rise to the concept of sustainable mining. Sustainable mining serves as a guideline for the mining sector, affirming that future sustainable development must be achieved.
The key objective of sustainable mining is to minimize harmful environmental and social impacts at every stage of operation, while also maximizing local benefits. Sustainable mining ensures that operations are managed in such a way that they are safe, do not pose risks to local communities or the environment, and also support the rehabilitation of mining areas to deliver sustainable benefits—particularly in the repurposing of land for other uses.
